AGREEMENT FOR SUBSCRIBERS:

Definitions

Subscriber will be defined as the person or persons, or organization purchasing subscriptions to Presentations for Teachers.

User will be defined as a member of the K– Post-Secondary public and/or private school/college/university (collectively the Community) entering the system via username and password; or a home access user entering the system via username and password.

Product and Content is the service provided by the Presentations for Teachers website.

GRANT OF LICENSE FOR USER AND PASSWORD

Presentations for Teachers grants the User permission to access the Presentations for Teachers website, and to use the Content located on the website provided that:  (i) all copyright and trademark notices are maintained on the Product and Content; and (ii) User agrees to be bound by the terms of this Agreement. This grant extends only to the User and may not be transferred to, or extended to, others. The Product and Content shall be used only by User for educational and research purposes and as otherwise may be set forth in this Agreement and it cannot be exploited for any commercial purpose or for the benefit of any other person or entity.

User agrees to maintain his/her User password as personal and confidential information, except in those instances where Subscriber and Presentations for Teachers have agreed that User may share his/her password with another User(s) within their institution if they so choose. The unauthorized use of the User's password for access to the Product and Content, with or without the User's knowledge, is a breach of this Agreement and a violation of  Presentations for Teacher's copyrights. The User is responsible for undertaking reasonable measures to prevent access by unauthorized persons to his/her password.

OWNERSHIP

User has no ownership rights in the Product and Content. Rather, User has a license to use the Product and Content only for as long as the Subscriber subscribes to the Product. Ownership of the Product and Content and all intellectual property rights shall remain at all times with Presentations for Teachers and/or its contributors.
 

PERMITTED USES

User will be permitted online access to the website in order that User may download PowerPoint™ Presentations and use such downloaded material for educational and research purposes.  The User may alter the material only for purposes of customizing the Content for their individual classroom, but may not remove any copyright notices or claim the original content as their own.

DURATION OF AGREEMENT AND TERMINATION

This Agreement will become effective subject to its terms and conditions upon acceptance of this Agreement by clicking on the "Subscribe" button and it will remain in effect for as long as Subscriber continues to subscribe to Product and User continues to use the Product according to the terms of this Agreement. Presentations for Teachers may terminate this Agreement for any reason, including, but not limited to, if Presentations for Teachers finds that any User has violated any of the terms of this Agreement.

Upon notification of termination of the Agreement or that the subscription is not renewed, all Content downloaded from the Website must be erased from any and all storage devices, such as a server, hard drive, CD, Zip disk, or other storage device.  Unauthorized use of Content may result in legal action. All provisions relating to Presentations for Teachers' proprietary rights shall survive the termination of this Agreement.
 

PRIVACY POLICY

Presentations for Teachers respects the privacy of its users and promises not to disclose personal or business information to third parties without the express permission from you.  We will not sell your name, e-mail address, or any other personal information to anyone else.  We consider this information to be private, and it will remain as such.  If you have questions about your privacy rights, or would like further information regarding the confidentiality of your interactions with Presentations for Teachers, contact us at support@presentationsforteachers.com .

ACCEPTANCE OF USE OF THE SERVICE

You agree to indemnify, defend, and hold harmless Presentations for Teachers and its contributors, employees, directors, and agents from and against any and all liability, claims, losses, damages, injuries, or expenses (including reasonable attorney's fees) directly or indirectly arising from or relating to any offer or other matter related to this agreement or the subject matter hereof and any dispute relating thereto.

Presentations for Teachers agrees to indemnify, defend, and hold harmless contributors from and against any and all liability, claims, losses, damages, injuries, or expenses (including reasonable attorney's fees) directly or indirectly arising from or relating to Presentations for Teachers negligence or willful misconduct in performance of the services or its breach of this agreement, except in cases of copyright infringement matters as stated earlier in this agreement.
